Rules for visiting the children's playground "Medvediya"

1. These Rules for visiting the children’s playground “Medvediya” (hereinafter — the Rules) are developed in accordance with the Civil Code of the Russian Federation, the Code of the Russian Federation on Administrative Offenses dated 30.12.2001 No. 195-FZ, the Law of the Russian Federation "On protection of consumer rights “dated 07.02.1992 No. 2300-1 and determine the procedure and conditions for serving visitors to the children’s playground “Medvediya” (hereinafter — “Medvediya”).
2. These Rules are a public offer and contain all the essential terms of the service agreement, thereby expressing the Contractor’s intention to consider himself to have concluded an agreement with the Client / visitor, who will accept these Rules.
3. Sochi-Park JSC assumes the rights and obligations of the Contractor, and the citizen who accepted the offer (responded with consent) — the Customer in accordance with these Rules, under the contract for the provision of services. The subject of the agreement is the provision of services, if possible, to stay in the territory of Medvediya, to participate in leisure and entertainment activities, to use the equipment on the conditions established by this offer.
4. These Rules are binding on all visitors to Medvediya without exception. Disagreement with the Rules or non-observance of the Rules by visitors of Medvediya entitles the Sochi-Park administration to refuse to provide services.
5. The Contractor offers an unlimited number of people access to Medvediya on the terms of these rules. An individual who wants to get access to the services of Medvediya, from the moment of acceptance of this offer, is a User, in connection with which he acquires the rights and bears the obligations provided for by this offer. Acceptance (unconditional acceptance) of the terms of this offer is payment for services. By his acceptance, the User confirms that he is: legally capable, capable and entitled to conclude an agreement on the provision of services, is familiar with these Rules, undertakes to comply with them until the end of the provision of services. The user who accepts this offer on behalf of his minor child guarantees constant monitoring of his actions, including not allowing violation of these Rules, except in cases of childcare by the Contractor.
6. The following concepts are used with the meaning adopted for the purposes of the offer in the text of these Rules.
   1. Medvediya is a children’s entertainment center located at the address: Sochi, st. Mezhdunarodnaya 12, which is a multifunctional center that includes play areas, play equipment, attractions, cafes. The use of play equipment requires exercise, including physical activity. Medvediya is not an object of physical culture and sports, an educational organization and is intended solely for leisure activities. Correct use and operation of equipment and facilities in no way creates a threat to the life and health of Visitors. Medvediya is intended for temporary stay of children, the mode of operation does not provide for individual work with children.
   2. Employees of Medvediya are Administrator, Senior Operator, Operator, Assistant Operator, whose powers by virtue of Part 1 of Art. 182 of the Civil Code of the Russian Federation are evident from the situation. The employee of Medvediya monitors the order on the territory of the children’s playground and has the right to give generally binding instructions for Visitors, warn about the inadmissibility of violations of the terms of this offer, take action against violators up to the end of the provision of services with the requirement to leave the territory of Medvediya.
   3. Visitor is children from 0 to 14 years old and a parent of a minor or accompanying persons (over 18 years old) of children from 0 to 14 years old.
   4. A bracelet is a paper product with an identification number, worn on the hand of each Visitor by an Employee of Medvediya, confirming the conclusion of a contract for the provision of services and allowing to keep track of the time of the Visitor’s stay in Medvediya.
   5. Price list for services is a list of prices for services rendered by Medvediya published on the information stand and on the website of AO Sochi-Park. There are different rates for individual, family, group and corporate visits. Before accepting this offer, the User is obliged to study the Price List and accept the prices under the service agreement.
   6. Site is a website on the Internet with the domain name sochipark.ru and all subdomains that contain information about the consumer properties and characteristics of the services provided, a description of Medvediya, photos, including from events, as well as announcements and other rules binding on Visitors.
7. Medvediya works according to the approved schedule. The last reception of visitors is carried out no later than 1 hour before the end of the work. Visitors have the right to be on the territory of the Center only during the opening hours established by the Administration. After the end of the specified time, Visitors are required to leave the territory of Medvediya. The administration reserves the right to change the time frame for visiting Medvediya. In this case, the Visitors are notified by placing an appropriate announcement.
8. The cost of visiting Medvediya is determined according to the current price list.
9. The administration has the right to stop the operation of certain amusement rides or play equipment, as well as parts of play equipment in connection with technical or service maintenance.
10. Medvediya is allowed for children aged 0 to 14 years, inclusive, weighing no more than 80 kg and no more than 160 cm in height. Children aged 3 to 14 are allowed to play equipment and attractions. Detailed restrictions for each play equipment and attraction are listed below.
    • The “Forest edge” trampoline arena is designed for children from 6 to 14 years old, weighing no more than 80 kg. At the same time, no more than 1 person can be on one section (net) of the trampoline, and no more than 4 people can be inside the trampoline set.
    • The “Honey Factory” Knitted labyrinth is intended for children from 3 to 12 years old, weighing no more than 50 kg and no more than 160 cm in height. At the same time, no more than 23 people with a total weight of no more than 1150 kg can be inside the product.
    • The “Skat kosogor” children’s play equipment is intended for children from 3 to 12 years old, weighing no more than 50 kg, height no more than 160 cm. At the same time, no more than 3 people with a total weight of no more than 150 kg can be on the equipment.
    • The “Tree of Life” large labyrinth is intended for children aged 3 to 12 years, weighing no more than 50 kg and no more than 160 cm in height. The “Tree of Life” is divided into 2 parts are large and small. No more than 80 people can be in a large part of the labyrinth at the same time. No more than 25 people can be in a small part of the labyrinth at the same time.
    • The “Visiting Potap” small labyrinth is intended for children from 3 to 12 years old, weighing no more than 50 kg and no more than 160 cm in height. At the same time, no more than 15 people with a total weight of no more than 750 kg can be inside the labyrinth.
    • The “Bears” attraction intended for children from 3 to 7 years old, weighing no more than 30 kg and no more than 120 cm in height. At the same time, no more than 4 people with a total weight of 120 kg can be on one carousel.
    • The “Raduga” children’s play equipment is intended for children from 3 to 7 years old, weighing no more than 30 kg and no more than 120 cm in height. No more than 1 person can be on the carousel at a time.
    • The “Birch” attraction is intended for children aged 3 to 10 years, with a maximum weight of no more than 35 kg and a height of no more than 120 cm. No more than 8 people with a total weight of no more than 280 kg can be on the carousel at a time.
11. Children under 4 years of age are obliged to visit Medvediya only when accompanied by a parent or an accompanying person (who has reached the age of 18), who ensure constant visual control of the child and are responsible for compliance with these Rules, the safety of children, as well as for damage caused by them. Children from 5 to 14 years old can stay in Medvediya without being accompanied by a parent or accompanying person (who has reached 18 years old) only if there is a guest questionnaire filled out by a parent or accompanying person (who has reached 18 years old). The questionnaire is a bilateral agreement and provides for the mandatory preliminary acquaintance of the Visitor with its terms and conditions and these Rules.
12. A parent or an accompanying person (over 18 years of age) can leave children in the play area upon presentation of a passport, driver’s license or serviceman’s ID and a fully completed and signed by parent or accompanying person (over 18 years of age) of Application Form.
13. The parent or accompanying person (who has reached the age of 18) who signed the questionnaire has the right to pick up the child.
14. The administration has the right to demand identity documents from a parent or an accompanying person (who has reached 18 years of age).
15. Administration of Medvediya has the right to ask a parent or accompanying person (over 18 years of age) to pick up a child who creates unsafe conditions for other children, without a refund.
16. Administration of Medvediya has the right to apply to law enforcement agencies in the absence of a parent or accompanying person (who has reached 18 years of age) after the paid time of the child’s stay in the territory of Medvediya.
17. A parent or accompanying person (over 18 years of age) must familiarize themselves with these Rules, explain the Rules to the child and urge them to follow them before visiting Medvediya.
18. Entrance to the Medvediya is carried out by tickets. You must familiarize yourself with these Rules and fill out a guest questionnaire before visiting Medvediya. The guest’s questionnaire can be viewed on the website or received from a Medvediya Employee or bring a completed questionnaire with you. Filling out the questionnaire confirms your agreement with these Visiting Rules for Medvediya. Only a parent or an accompanying person (who has reached the age of 18) has the right to sign the questionnaire upon presentation of an identity document (passport, driver’s license, serviceman’s ID). The visitor purchases an entrance ticket only after he reads the rules for visiting Medvediya and leaves his signature in the guest’s profile.
19. The service of being in the territory of Medvediya is provided by the Contractor for a limited amount of time. After the end of the paid time, the Visitor must leave the playing area within 10 minutes. In case of exceeding the declared (initially paid) number of hours, the Visitor is obliged to make an additional payment at the exit, in accordance with the price list valid on the day the service is provided, after which the Bracelet will be removed. In case of being in the game zone for a time less than that paid in accordance with the Price List of the cost of services, the paid amount is not returned to the Visitor, because proportional receipt of the service in a cost / time ratio — not provided.
20. The beginning of a visit to the playing area is considered to be when the Visitor crosses the entrance turnstile using the Ticket. The beginning of the visit to the gaming area is recorded by the electronic payment and access system and is activated by applying the ticket to the reader (validator) of the entrance turnstile.
21. The ticket, together with the sales receipt, must be kept by the parent or accompanying person (over 18 years of age) for the entire duration of the visit and entitles you to a one-time visit to Medvediya. The bracelet must be worn on the child throughout the visit.
22. Children’s clothing should be loose, not restricting the movement of arms and legs, but protecting from injury, children should be on the playground in socks without shoes. Visitors to Medvediya are required to take off their outerwear and shoes in the designated place before visiting the play area in accordance with the sanitary and epidemiological legislation. The entrance to the play area is carried out only in removable flat-soled shoes or without shoes (socks, tights, socks, etc.). Visitors are not allowed to be barefoot in the play area.
23. The decision on the admission of children and a parent or accompanying person (who has reached the age of 18) is made by the operator based on the maximum number of visitors, which in total cannot exceed 170 children. Upon reaching the maximum allowable number of visitors, the Administration has the right to temporarily terminate the admission of visitors.
24. The decision to admit children with disabilities to Medvediya is made by the operator based on circumstances that may affect the safety of such a visit.
25. The following persons are not allowed to the Medvediya:
    • having medical contraindications for health reasons;
    • having various kinds of injuries, fractures at the time of visit, with plaster, with any types of prostheses;
    • after recently transferred operations;
    • with diseases of the brain;
    • suffering from diseases of the nervous system;
    • with diseases of the musculoskeletal system;
    • with disorders of the vestibular apparatus;
    • with cardiovascular diseases;
    • in the presence of a pacemaker, hypertension, arterial hypertension, congenital and acquired heart defects, etc.;
    • with headache, epilepsy;
    • with infectious, allergic, latent and chronic diseases that can harm other guests;
    • with problems in the back and neck;
    • having herniated intervertebral discs;
    • with scoliosis of the 3 type;
    • with congenital malformations of the spine;
    • using corsets to fix the cervical vertebrae;
    • taking medications that have a depressing effect on the central nervous system.
    In cases of providing independent supervision of a child during the passage of the equipment, the parent or accompanying person (who has reached the age of 18) must carefully monitor the child’s well-being. If a parent or an accompanying person (over 18 years of age) suspected a deterioration in the child’s well-being, or the child reported a deterioration in well-being, it is necessary to stop passing obstacles.
26. The operator has the right to refuse to visit Medvediya children with obvious signs of viral, skin diseases.
27. It is prohibited on the territory of Medvediya:
    • entrance in outdoor shoes and outerwear;
    • visiting play equipment without socks, barefoot;
    • hang, swing on the grid of the play equipment, untwist it;
    • climb the walls of the play equipment, suspension elements, pipes, jump from them and from the structure of the play equipment;
    • visit with rings, bracelets, dangling earrings, long beads, long hair should be gathered and fastened;
    • to be on each game element more than 1 person, on the game equipment in a larger number and in violation of the restrictions of paragraph 3 of these Rules;
    • eat or drink while the child is on the play equipment;
    • throw objects down and at other visitors;
    • to be in a state of alcoholic or narcotic or psychotropic intoxication, as well as carry and consume on its territory any drinks containing alcohol;
    • to carry any items that may pose a danger to other visitors, including stabbing, cutting, bulky, fragile (including cell phones, tablets, toys, sharp hairpins, jewelry, paint bottles);
    • to bring in flammable, explosive objects and substances, pyrotechnic items (including but not limited to: fireworks, petards, smoke bombs, flares, sparklers, etc.);
    • to bring and use any means of self-defense, including but not limited to: gas and pepper spray cans, stun guns, weapons of limited destruction;
    • to be on the gaming equipment with food and drinks, including sweets, lollipops, chips, etc .;
    • to store valuables in cells;
    • to smoke, including electronic cigarettes, smoking mixtures and their analogues;
    • pass with animals, birds, reptiles, reptiles, insects and other species or objects of the animal world;
    • to climb onto the enclosing walls and hang on them;
    • to touch the sections and sleeves of the attraction with sharp and other objects;
    • turn off / on equipment, touch service equipment, untie / tie protective sleeves and mats;
    • to jump and push when going up and down, at the entrance, steps or on top of play structures;
    • to run, roll over, somersault, push, behave rudely with other visitors, jump on them, interfere with the movement of other visitors;
    • to perform any acrobatic stunts;
    • to slide down the slides by more than one person on one slope;
    • to slide down slides in any position other than feet down;
    • to slide down the slides standing or squatting, slide down them upside down;
    • jump from slides, cling to other visitors while riding;
    • climb up the slide, jump along the slide, roll along the slide before the previous child left;
    • roll upside down or on your stomach;
    • to slide with foreign objects, go up from the side of the descent;
    • stop and close the passage at the end of the slides;
    • distract visitors while jumping on a trampoline and sliding down a slide;
    • go to the playground in roller skates, scooters, bicycles, strollers and other devices for movement.
28. Employees are not responsible for the injuries of children received during their stay in Medvediya, as well as for the loss of personal belongings, material values resulting from non-compliance with these Rules.
29. In the event of damage to equipment or damage to inventory and cells by children, the parent or accompanying person (over 18 years of age) shall reimburse the full cost of such damage.
30. Employees of Medvediya are trained in providing first aid to children and, if necessary, have the right to provide it, as well as call a paramedic on duty and an ambulance.
31. Medvediya employees have the right to provide children with drinking water in disposable containers only at their request.
32. All persons visiting Medvediya must comply with the requirements of these Rules and follow the instructions of the personnel for safety reasons.
33. The administration of Medvediya reserves the right to ask the child and the parent or accompanying person (who has reached the age of 18) to leave the territory in case of non-compliance with these Rules or the instructions of the staff, as well as if the behavior / health condition of the child interferes with leisure and causes harm to the health of other children.
34. Violators may be denied subsequent visits to Medvediya in the event of repeated violations of the Rules.
35. In the event of an emergency (fire, accident, threat of a terrorist act), it is necessary to leave the playing area without panic, put on outerwear and shoes as quickly as possible (if the situation allows), and leave the building using the main and emergency (evacuation) exits or stairs, following instructions from Medvediya staff.
36. In the event of an emergency (a threat of fire or smoke in Medvediya or the surrounding area, another threat to the life, health or safety of a child, etc.), the Administration reserves the right without consent, but with the subsequent notification of parents, other legal representatives, change the location of the child, delivering him to a safe place. The location of the children after the evacuation is indicated in the Questionnaire.
37. In order to organize the safe stay of Visitors Medvediya, the Administration reserves the right to change and supplement these Rules without prejudice to the rights of Visitors. The current version of the Rules is published on the website, as well as information stands located in Medvediya.
